TERMS AND CONDITIONS
Effective Date: August 13, 2025
These Terms and Conditions (“Agreement”) are entered into between Nodeviv Smart Automation Solutions Private Limited (CIN: U80200DL2025PTC449628), operating under the brand name “Securiky” (“Company,” “we,” “us,” or “our”), having its registered office at 1629, F/F, Janta Flat, GTB Enclave, Nand Nagari, Delhi, India, 110093, and the customer (“Customer,” “you,” or “your”) who purchases or uses Securiky’s products and services.
BY CHECKING THE BOX AND/OR USING SECURIKY’S HOME ALARM SYSTEM, SMART AUTOMATION PRODUCTS, OR ANY SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
1. ACCEPTANCE OF TERMS
By purchasing, installing, or using any Securiky products or services, including but not limited to our alarm security systems, IoT-based sensors, mobile applications, monitoring services, and any related equipment or services, you agree to comply with and be bound by these Terms and Conditions.
2. NATURE OF SERVICES AND LIMITATION OF LIABILITY
2.1 Preventive System Disclaimer
THE CUSTOMER EXPRESSLY ACKNOWLEDGES AND AGREES THAT:
- Securiky’s security systems are PREVENTIVE and DETERRENT measures designed to alert you and/or emergency services of potential security breaches
- These systems DO NOT GUARANTEE prevention of burglary, theft, fire, medical emergencies, or any other incidents
- The security system may be circumvented, bypassed, or defeated by sophisticated criminals or through system failures
- Securiky SHALL NOT BE LIABLE for any losses, damages, injuries, or deaths that may occur despite the presence of our security system
- This is NOT an insurance policy and does not provide coverage for losses
2.2 No Warranty Against Criminal Acts
The Company makes no representation or warranty that its products or services will prevent any loss, damage, or injury. Criminal acts, natural disasters, and other events are beyond our control, and we cannot guarantee that such events will not occur.
2.3 Limitation of Liability
Under no circumstances shall Securiky, its officers, directors, employees, agents, or affiliates be liable for:
- Any direct, indirect, incidental, special, consequential, or punitive damages
- Loss of property, profits, data, or business opportunities
- Personal injury or death
- Any damages resulting from system bypass, failure, or malfunction
- Any losses occurring due to customer negligence, misuse, or failure to properly maintain the system
2.4 Maximum Liability Cap
In the unlikely event that Securiky is found liable despite these limitations, our maximum liability shall not exceed:
- The total amount paid by the Customer for services in the 12 months preceding the incident, OR
- ₹10,000 (Ten Thousand Rupees only), whichever is LOWER
2.5 Professional Advice Disclaimer
- All security recommendations are general in nature
- Customer should consult independent security professionals for specific needs
- We do not guarantee that our system meets any specific security standards unless explicitly stated in writing
3. 24/7 MONITORING SERVICE TERMS
3.1 Monitoring Service Scope
- Our 24/7 monitoring service provides remote observation and response capabilities
- Monitoring personnel are trained professionals operating from secure control centers
- We endeavor to contact you within 60 seconds of an alarm trigger
- This service DOES NOT GUARANTEE prevention of any incidents or crimes
- Response times may vary based on system load, technical issues, or force majeure events
3.2 Emergency Services Authorization
BY ACCEPTING THESE TERMS, YOU EXPRESSLY AUTHORIZE SECURIKY TO:
- Contact police, fire brigade, ambulance, and other emergency services on your behalf
- Provide emergency services with your personal information including but not limited to:
- Full name and contact details of all registered users
- Complete premises address and access instructions
- Medical conditions or special circumstances (if provided)
- Floor plans and vulnerable areas information
- Vehicle details and other relevant security information
- Act as your authorized agent in reporting potential emergencies when:
- We cannot reach you within 60 seconds of an alarm trigger
- You fail to provide the correct password/verification code
- We determine, in our sole discretion, that an emergency situation may exist based on:
- Multiple sensor activations
- Audio/video evidence of intrusion
- SOS button activation
- Unusual alarm patterns
- Your explicit request through the app or phone
- Make decisions about emergency dispatch based on available information
- Share alarm history and patterns with law enforcement if requested
3.3 False Alarm Responsibility
- You are solely responsible for any fines, fees, or penalties imposed by authorities due to false alarms
- False alarm fines in Delhi NCR can range from ₹500 to ₹10,000 per incident
- Repeated false alarms may result in:
- Suspension of emergency dispatch services
- Additional verification requirements
- Increased monitoring fees
- Termination of services
- Securiky is not liable for any consequences arising from emergency service dispatch
- You must reimburse Securiky for any costs incurred due to false alarms
3.4 Guard Response Coordination
When guard services are subscribed:
- Guards are NOT first responders to alarm events
- Monitoring center will NOT directly communicate with on-site guards
- Customer must establish separate protocols for guard response
- Guards should NOT attempt to confront intruders without police presence
- In case of alarm activation:
- Monitoring center follows standard emergency protocols
- Customer is responsible for alerting on-site guards
- Guards should secure perimeter and await authorities
- Guards must not tamper with crime scenes
- Securiky is not liable for guard’s failure to respond appropriately
- Guards are instructed to prioritize their own safety
4. CUSTOMER RESPONSIBILITIES
4.1 System Maintenance and Care
The Customer agrees to:
- Use the system with proper care and in accordance with provided instructions
- Regularly test the system as recommended (minimum monthly)
- Replace batteries when indicated (within 7 days of low battery alert)
- Keep all sensors and equipment clean and unobstructed
- Ensure continuous power supply and internet connectivity
- Not allow minors or unauthorized persons to operate the system
- Maintain proper environmental conditions (temperature 10-40°C, humidity <80%)
- Protect equipment from physical damage and environmental hazards
- Use only Securiky-approved accessories and power adapters
- Schedule annual maintenance checks (free for active subscribers)
4.2 Notification Requirements
You MUST notify Securiky within 48 hours of:
- Any changes to system settings or configurations
- Relocation or repositioning of any system components
- Changes to emergency contact information
- Any system malfunctions or issues
- Changes to premises layout that may affect system performance
- Any renovation or construction work that may impact sensors
- Change in occupancy status (vacant periods exceeding 72 hours)
- Any suspected equipment defects for warranty claims
- Damage to equipment from any cause
- Power outages or internet disruptions lasting over 24 hours
4.3 Access Credentials
- You are responsible for maintaining the confidentiality of all access codes, passwords, and fob keys
- Any actions taken using your credentials are your sole responsibility
- Report lost or stolen fob keys immediately
- Change access codes at least every 90 days
- Do not share credentials with third parties without written consent from Securiky
4.4 Warranty Compliance Obligations
To maintain warranty validity, Customer must:
- Not attempt any repairs or modifications
- Report defects within 48 hours of discovery
- Provide access for warranty service within reasonable time
- Maintain proof of purchase and installation documents
- Cooperate with troubleshooting procedures
- Accept equivalent replacement models when original unavailable
- Not use equipment in extreme or unsuitable environments
- Follow all usage guidelines provided
5. PAYMENT TERMS
5.1 Payment Obligations
- Customer agrees to pay all fees according to the selected service plan
- Payments must be made on time as per the agreed schedule
- Late payments may result in service suspension or termination
- A late payment fee of ₹500 or 2% of outstanding amount (whichever is higher) applies after 7 days
- Guard service charges are billed separately and in advance
- Non-payment may result in immediate withdrawal of guard services
5.2 Service Suspension
Securiky reserves the right to suspend or terminate services for non-payment without prior notice, and shall not be liable for any consequences arising from such suspension. Guard services may be withdrawn immediately upon payment default.
6. SYSTEM TAMPERING AND MODIFICATIONS
6.1 Prohibition on Modifications
The Customer SHALL NOT under any circumstances:
- Open, disassemble, modify, or tamper with the main console box or any system components
- Attempt to reverse engineer, hack, or modify any software or firmware
- Remove, damage, or obscure any serial numbers or identification labels
- Install third-party software or modifications
- Bypass or disable any security features
- Move or relocate equipment without prior written consent from Securiky
6.2 Consequences of Tampering
Any unauthorized modification, tampering, or research & development (R&D) on the system will:
- Immediately void all warranties and service agreements
- Terminate our monitoring obligations without refund
- Make the Customer fully liable for any damages or losses
- Result in immediate system deactivation
- Potentially subject the Customer to legal action for breach of contract
6.3 System Inspection Rights
Securiky reserves the right to:
- Remotely monitor system integrity and detect tampering
- Conduct physical inspections upon reasonable notice
- Disable the system if tampering is detected
- Refuse service if unauthorized modifications are discovered
6.1 Insurance Services
- Insurance coverage is provided by third-party insurance companies
- Securiky acts only as a facilitator and is not the insurance provider
- All insurance claims, terms, and conditions are subject to the third-party insurer’s policies
- Securiky is not responsible for claim processing, approval, or denial
- Customer must maintain separate property insurance regardless of our services
6.2 M2M SIM Card Services
- Cellular connectivity is provided through third-party carriers
- Network availability and quality are beyond our control
- We are not liable for service interruptions due to network issues
- Customer is responsible for any additional cellular data charges
7. TECHNICAL FAILURES AND FORCE MAJEURE
7.1 System Limitations
Securiky shall not be liable for system failures or malfunctions due to:
- Power outages or electrical issues
- Internet or network connectivity problems
- Environmental factors (weather, temperature, interference)
- Equipment wear and tear
- Third-party service failures
- Customer-induced damages or modifications
7.2 Force Majeure
We are not responsible for failures caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, government actions, or pandemic.
8. DATA PROTECTION AND PRIVACY
8.1 Data Collection
By using our services, you consent to the collection, storage, and processing of:
- System usage data
- Alarm event information
- Video footage (where applicable)
- Personal and premises information
8.2 Data Sharing
- We may share your information with:
- Emergency services when authorized
- Third-party service providers as necessary
- Legal authorities when required by law
9. INTELLECTUAL PROPERTY
All software, applications, designs, and technologies used in Securiky products remain our exclusive property. You receive only a limited license to use these for personal/business security purposes.
10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Securiky and its affiliates from any claims, damages, losses, or expenses arising from:
- Your use or misuse of our products/services
- Your violation of these terms
- Your negligence or intentional misconduct
- False alarms or unnecessary emergency service dispatch
11. DISPUTE RESOLUTION
11.1 Governing Law
This Agreement shall be governed by the laws of India, and courts in Delhi shall have exclusive jurisdiction.
11.2 Arbitration
Any disputes shall first be attempted to be resolved through arbitration under the Arbitration and Conciliation Act, 2015.
12. MODIFICATIONS
Securiky reserves the right to modify these terms at any time. Continued use of our services after modifications constitutes acceptance of the revised terms.
13. SEVERABILITY
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
14. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, representations, or understandings.

16. ADDITIONAL PROTECTIVE PROVISIONS
16.1 Assumption of Risk
Customer acknowledges that no security system is foolproof and voluntarily assumes all risks associated with relying on the system for protection.
16.2 Statute of Limitations
Any claims against Securiky must be brought within one (1) year of the incident giving rise to the claim, regardless of when the damage was discovered.
16.3 No Third-Party Beneficiaries
This Agreement is solely for the benefit of the parties and creates no rights for any third parties.
16.4 Waiver of Consequential Damages
Customer waives any right to claim consequential, special, or punitive damages, even if Securiky was advised of their possibility.
16.5 Equipment Ownership
Until full payment is received, all equipment remains the property of Securiky, and we retain the right to remotely disable the system for non-payment.
17. RESPONSIBLE USE OBLIGATIONS
17.1 Lawful Use Only
Customer agrees to:
- Use the system only for lawful purposes
- Not use the system to spy on or record individuals without proper consent
- Comply with all privacy laws regarding video and audio recording
- Not use the system for harassment or intimidation
17.2 False Alarm Prevention
Customer must:
- Train all authorized users on proper system operation
- Maintain an updated list of authorized users
- Implement measures to prevent accidental triggering
- Pay all fines or penalties resulting from false alarms
17.3 Cooperation with Investigations
Customer agrees to cooperate fully with any investigation related to system use or security incidents.
